A question which is raised a lot in legal circles in Georgia is when a driver which is at fault is involved in an accident and does not have insurance, is there anything that can be done?

This is a question my firm gets a lot. The fact is that all drivers are required under Georgia law to maintain liability insurance coverage. And does that happen? Absolutely not. The reality is not all drivers have any insurance on their vehicles. As a driver in Georgia, it would be beneficial to attempt to protect yourself from uninsured drivers.

And how do you do that? Well, there are a number of ways but the most common is to select the underinsured/uninsured motorist coverage on your insurance policy. This insurance offers you coverage if you are not at fault and the at-fault party either does not have coverage, or does not have enough coverage.

At this time the minimum limits of insurance coverage is $25,000/$50,000. What that means is that I you select the minimum insurance coverage it will afford no more than $25,000.00 per person and no more than $50,000.00 per accident no matter how many people may be involved.

If you have underinsured/uninsured motorist coverage and are ever involved in an accident it is recommended that you notify your insurance company immediately.

While currently as of the date of this post, you may have a two year statute of limitation of bringing a claim against another driver that may not apply to your own insurance due to the contract for coverage. In most insurance policies, notice is required within days of a collision. And the insurance carriers are very strict with this limitation. If no notice is provided to the insurance pursuant to your policy the insurance company can and will deny you coverage. If you have any questions it is best to put them on notice and set up a claim.

Another situation to be concerned with is the large number of collisions where there is either no insurance or not enough insurance. So, to make sure your family is protected look into underinsured/uninsured motorist coverage so you will not find yourself staring at large repair bills or hospital bills because you didnt have enough coverage.

Finally, if in doubt try seeking advice from a reputable firm that has good knowledge of this area. This is a specialised discipline and one that you would be well advised to seek advice on to make sure that you are well protected.
